Terms of Service

Bitehood is operated by [Legal name / company] (see Imprint). Bitehood provides a marketplace where private home cooks ("sellers") can offer homemade food to people nearby ("buyers").

Bitehood is not a party to the sale. Any agreement about food is concluded directly between buyer and seller. Bitehood does not prepare, handle, store, transport or inspect food, and does not process payments — buyers and sellers arrange payment and handover between themselves.

You must be at least 18 years old to create an account. Provide accurate information, keep your password confidential, and tell us promptly if you suspect unauthorised access. You are responsible for activity under your account.

By publishing a listing you confirm that:

• you are legally permitted to prepare and sell the food you offer, and you comply with all applicable food safety, hygiene, licensing, labelling and tax rules where you live;
• your ingredient and allergen information is complete and accurate — allergens must be declared for every listing;
• your photos show the actual food you are offering;
• your price, portion size, availability and pickup/delivery details are correct.

You are solely responsible for your listings and for the food you sell, including any harm it causes. Registering income and paying tax on your sales is your responsibility.

Read ingredient and allergen information before ordering, and contact the seller if anything is unclear or if you have an allergy or intolerance. A reservation is a request; the seller decides whether to accept it.

Because homemade food is perishable and made to order, orders generally cannot be cancelled once a seller has accepted them. Arrange cancellations directly with the seller.

Don't use Bitehood to sell alcohol, tobacco, cannabis, medicines, supplements with health claims, or anything else you are not licensed to sell. Don't post false, misleading, offensive or infringing content, don't harass other users, don't scrape the platform or attempt to circumvent its security.

You keep ownership of the text and photos you upload. You grant Bitehood a non-exclusive, royalty-free licence to display and distribute that content on the platform for the purpose of operating and promoting the marketplace. You must have the rights to everything you upload.

We may remove listings or content and suspend or terminate accounts that breach these terms or the law. For serious breaches this can happen without prior notice. Where required by the EU Digital Services Act, you will be given a statement of reasons and an opportunity to object.

Bitehood is liable without limitation for injury to life, body or health, for intent and gross negligence, and under the German Product Liability Act. For slight negligence we are liable only where an essential contractual obligation is breached, and then limited to foreseeable, typical damage.

Bitehood does not warrant the quality, safety or legality of food offered by sellers, or the accuracy of their listings. Claims arising from a purchase are directed at the seller.

We may change these terms; we will notify you of material changes in good time and you may terminate your account if you disagree. You can delete your account at any time.

The law of [country] applies, excluding its conflict-of-law rules. Mandatory consumer protection rules of your country of residence remain unaffected.
